Emamiyeh’s jurisconsult incumbent respecting dignity of poor and indigent person, but they enjoin to him that s/he must attempt to pay his/her dept with all legal (Shari’ee) ways, but the wealthy debtor who does not pay his/her debt is sans from this respect and s/he is deserving the Ruler’s crackdown. In Emamiye’s jurisprudence come in contact with a debtor who does not pay his debt could divide in two branches: in first view such a debtor must arrested from the ruler, but in the second view the ruler for arresting the debtor is free to chose. Furthermore, in Shafe’ee’s jurisprudence with arresting and Ta’zir the property of debtor also would sell. It seems that there is no need to arrest the fiscal owing because when the point is totally fiscal and debtor is wealthy we could besides upon arrival the claim use new ways for fiscal punishments.

The aim of this article is with a new outlook and paying attention to definition of judgment as a lexical term and jurisconsult’s terms and with considering that in book and Sonnat, is to understand the concept of judgment. Most of jurisconsults of Islamic sects define “judgment” as resolving enmity which philologist remarks, Qur’an verses, Prophet Mohammad (PH) Hadith and A’emeh (PH) Hadith is corroborant this definition; and this concept defined in any of them expressly or symmetrically. On other hand, if we define this word in this way, it would not include judging through God’s orders which some scholars such as the first Shahid, an Emamiyeh jurisconsult, Yahya Ebn Sharaf Nouvi- a Shafe’ee jurisconsult- and Ja’fari Langaroudi without mentioning to this difference try to define this word in the way that include these points as well.

In the history there are 4 approaches about variety and intensity of religions and sects: refutability, monopoly, pluralism. Although the principals of other religions is not comparable with Islam but wily all of them covering the truth, even if we accept changes of other religions, nevertheless there is pieces of truth in them, so pluralism in the rightness of the truth is consistent. In the issue of rescue, Islam is not only a monopolist religion but also deliver followers of other religions with some conditions. Pluralism is an important issue in philosophy in temporary era which has permeated to various branches such as religion, politics, culture, sociology and ethics. In this case religious pluralism which for the first time introduce by John Hik –contemporary philosopher- has a special importance. If we look carefully, religious pluralism is connect with other topics of philosophy of religion such as Hermeneutic, religious experience and religious mysticism, language of religion, meaningful, ascertainably of religion’s points, skepticism, relativism and…and these issues have a strange connections with each other.
