Abu Bakr Ahmad ibn Hussein Khosrowjerdi al-Bayhaqi is one of the famous Sunni scholars in the fourth and fifth centuries AH and the golden age of Sunni hadith. He is one of the promoters and revampers of Shafi‘i school and the books “Al-Sunan Al-Kubra”, “Ma‘rifah Al-Sunan wa Al-Athar”, and “Ma‘rifah Al-Sughra” are highly credited to Sunnis. His other work is “Shu‘ab Al-Iman” which is written according to an important hadith of the Prophet expressing the number of branches of faith. This is a comprehensive book of religious and moral traditions, which was greatly influenced by the book “Al-Minhaj” by Halimi and has 77 sections. Its salient features include mentioning the documents and ways of the hadiths with reference to tolerance, criticism of documenting and content of the hadiths, identifying the forged traditions and avoiding quoting them, categorization, interpretation and explanation of the hadiths, giving odd points and quoting historical reports which distinguish this work from other similar works.

Unity of Place and Connection of Ranks in Congregational Prayer from the Perspective of Jurisprudence of Islamic Denominations

One of the conditions of the congregational prayer is the connection between the ranks of the prayer. According to the jurisprudence of the Imamiyyah, the ranks of the prayer should not be more than one step or a distance that is considered to be customarily close, whether the Imam and the follower are in the same place like a mosque or different places. Traditions, consensus and requirements of the custom of the believers, are among the evidences of Imamiyyah’s view. Sunni scholars, referring to the consensus, believe that in the case of unity of place in congregational prayer, it is sufficient for followers to be aware of the Imam’s prayers to follow him, and if the prayer is performed in the mosque, the congregational prayer is correct even if the ranks are distant, and if the prayer is performed outside the mosque, some consider the distance less than 300 meters necessary and some believe that a customary closeness is sufficient but some others believe that closeness of the ranks is not necessary. In this paper, using descriptive-analytical method and library resources, we study and analyze different perspectives in this field in order to achieve the Shariah order of joining the ranks of congregational prayer and explaining the amount of distance between ranks. According to the research findings and the author’s point of view, the necessity to observe a standard step distance between ranks whether in the mosque or outside is proportionate and the unity of prayer is not included in this order.

Option of Condition is one of the most widely used legal entities in Islamic jurisprudence and Islamic law and has an impact on the relations between the parties of contracts, which have been explained by the jurisprudents of Islamic denominations. One of the most controversial issues surrounding this option is whether the period of the option should be attached to the contract or can it be disconnected? All Islamic religions have accepted the option of condition itself, but the Sunni jurists do not consider it to be detached. However, the jurists of Imamiyyah and Abu Yusuf Hanafi consider the Option of Detached Condition to be correct. The findings of this descriptive-analytical study show that Imamiyyah and Abuyusef’s theory is stronger due to the existence of rational expediency and to the reasons for the legitimacy of the option of condition and the generality of the tradition “المؤمنون عند شروطهم” which means “The believers are upon their conditions.” and the believers are not bound about this and also the philosophy of legitimacy of the option of condition. As a result, the contract of detached condition will be correct.

One of the issues discussed in Islamic jurisprudence, is permission or the lack of permission for women to hold positions like the leadership of the government. This descriptive-analytical study paid to comparative study of this issue in Jurisprudence of Islamic Denominations and Iranian Law. In Jurisprudence of Islamic Denominations, except one sect (Shabibiyyah), all consider that women are not authorized to hold this position. In the legal system of Iran, it is best to reconcile the rule of Islamic law (the will of God) and the rule of law (the will of the people) and the management of the society that based on the rules of the Islamic jurisprudence has been placed on Wali al-Faqih and management of society that based on the rule of law has been placed on the elected leader of the people. The prohibition of leadership of women has just been put in the jurisprudential aspect, and it is the position of Wilayah al-Faqih. There are no prohibitions on the subject in this regard.

Al-Mizan’s author has widely cited, analyzed and judged the views of commentators from different Islamic Denominations during his interpretative discussions. One of these interpretations which had a special value for Allameh Tabatabi is Zamakhshari’s interpretation of the Holy Quran called “Al-Kashshaf”. Allameh has cited and used this interpretation in many cases and in several other cases he has also confirmed his interpretive views. Besides, he has reviewed and compared Zamakhshari’s perspective with his own and other interpreters’ opinions in many different cases. He has mentioned Zamakhshari’s interpretation slips and discussed or rejected these views with Quranic documentation and reasons. This study is a descriptive-analytical one with the aim of finding the attitude of Allameh towards the viewpoints of Zamakhshari in the interpretation of al-Mizan. Therefore, the author cites examples of verses in which he explores the interpretation of Kashshaf, as an example, after discovering the different types of Allameh studies in al-Mizan that of course, in the controversial discussions that have followed Zamakhshari’s view and the statement of Allameh’s judgment, these two commentators have commented on several reference interpretations of Shiite and Sunni commentators {As standard interpretations}, often because of Allameh’s view {The reason for the Quran being documented} is more correct and sometimes Zamakhshari’s view is preferred to Allameh’s. As a result, although the two commentators disagree on a number of occasions, they substantially share a common understanding of the Quran, in which Allameh occasionally endorses the views of Zamakhshari’s, citing his views, and also expurgates, corrects, and criticizes his views.

“Blowing the Trumpet” is one of The Signs of Time that interpreters have different views about its nature and its number. So, this paper is trying to show the chosen view by traditional reasons in a descriptive-analytical way. As a result of trusting on Quranic reasons and “principle of precise and literal meaning of a word”, words are coined for the kernel of meaning and blowing in trumpet is existential work of giving life and making death. According to Quranic verses, narrations and intellectual reason, numbers of trumpet blowing are three. Its direct doer is Almighty Allah and sometimes it ascribes indirectly to the Angel Israfil and his agents.
