This paper, through attributive method, seeks to answer this question that “what is the decree of promising to sell the human body organs in the viewpoints of Shiite and Sunnite jurisprudents, and which solutions the advocates of prescribing this action should provide to the challenges ahead?” To answer this question, this paper examines the concept, context, and foundations of human ownership of organs and the promise to sell the human body organs, and then examines the opinions of jurisprudents to solve the objections raised by the opposition. Regarding the possibility of such transactions, some jurists have challenged the possibility of carrying out such obligatory acts such as organ transplantation, harassment, mutilation, and ultimately rejected such deals. In this paper, the opinions of Sunni jurisprudents have been accepted and solutions from the Sunni jurisprudents have been expressed to reject these challenges. As a general rule, promise to sell human body organs is permissible according to majority of jurisprudents of the Islamic denominations, but due to cases such as human dignity and the possibility of harmful injury, it is not possible to forcibly commit to fulfill the obligation in the event of violation of the provisions of the contract and it must inevitably be ordered to disengage Contract based on commitment.}, keywords = {Promise to Sell the Human Body Organs,Ownership of Body Organs,organ transplantation}, title_fa = {تحلیل فقهی و حقوقی حکم وعده بیع اعضای بدن انسان و بیان چالشهای تجویز آن در مذاهب اسلامی}, abstract_fa = {وعده بیع اعضای بدن انسان، عملی حقوقی است که مطابق آن، انسان در دوران حیات خود، به انجام بیع بر اعضای بدن خود تعهد نموده و در قبال تعهد انجام شده، وجهی مطابق با شرایط مورد توافق دریافت می­‌کند. این مقاله، به روش اسنادی به دنبال پاسخ به این سؤال است که حکم وعده بیع اعضای بدن انسان در آرای فقهای شیعه و اهل­‌سنت چیست و موافقان جهت تجویز این عمل، باید چه راه‌حلهایی در برابر چالشهای پیش رو ارائه نمایند؟ مقاله حاضر برای پاسخ به این پرسش، به بررسی مفهوم، زمینه و مبانی مالکیت انسان بر اعضای بدن، حکم وعده بیع اعضای بدن، و آرای فقها جهت حل ایرادات مطرح شده توسط مخالفان، پرداخته است. با توجه به امکان پذیرش چنین معاملاتی، برخی فقها چالشهایی مبنی بر عدم امکان انجام اسباب واجب این نوع معاملات از جمله پیوند عضو، آزار و اذیت رساندن، مثله کردن و در نهایت حرمت چنین معاملاتی را مطرح کرده­‌اند. در این مقاله، با پذیرش آرای فقهای اهل­‌سنت و بیان راه­‌حلهایی از فقهای اهل­‌سنت، به رد چنین چالشهایی پرداخته شده است. به طور کلی وعده بیع بر اعضای بدن انسان، مطابق با نظر مشهور فقهای مذاهب اسلامی جایز بوده، اما به جهت مواردی همچون کرامت انسانی و امکان ضرر جانی، در صورت تخلف از مفاد قرارداد، امکان اجبار متعهد بر انجام تعهد نبوده و به ناچار باید بر فسخ قرارداد مبتنی بر تعهد حکم نمود.}, keywords_fa = {وعده بیع اعضای بدن,مالکیت اعضا,پیوند اعضا}, url = {https://foroughevahdat.mazaheb.ac.ir/article_104985.html}, eprint = {https://foroughevahdat.mazaheb.ac.ir/article_104985_7f7982bd36711f8e10c6c880b6323a1f.pdf} }
