In general, items proving penal case considering degree, validity, and rank are: the judge’s knowledge, confession, witness, oath taking and Qasamah (oaths of 50 people). Accordingly, oath is considered a valid proof in cases where there are no stronger proofs available. From the perspective of Positivist Realm, there is no oath taking in Hadd and Ta‘zir cases according to Shia clerics who take into account Prophet Mohammad’s (PBUH) tradition: (البیّنة علی المدعی والیمین علی من انکر) “Bringing evidence is the accuser’s task and taking an oath is the defendant’s”, and (لایمین فی حدّ) “Taking oath in crimes resulting in Hadd is unacceptable”. Considering that Shia provides the basis for the Iranian Laws, according to the Iranian Penal Law number 208, Hadd and Ta‘zir cannot be proved or disproved by taking an oath; however, things like Qisas (retaliation), Diyah (definite compensation money), Arsh (indefinite compensation money), damage caused by the crime could be proved by oath taking. In Hanafi clerics’ view, Dar’ rule and the previously mentioned Haddiths, prevents the acceptance of oath in Hadd but oath taking in absence of witnesses for the accuser, in cases like murder and theft and so on is applicable because it pertains to Haq al-Nas (the people’s rights). In Qisas (retaliation) of the body parts, since Hanafi clerics equate body parts with properties like monetary belonging, oath taking is applicable. All that has been said about Hanafi views is practiced in the law of Afghanistan as according to second penal law of Afghanistan, except Ta‘zir, everything is in keeping with Hanafi jurisprudence. Ta‘zir, likewise, on the ground that is seen as a definite right, can be disproved with an oath taking. Above all, Qasamah, as a group of oaths from the side of the accuser and his/ her relatives in cases where there is a lack of evidence, is put forth to prove murder or charges or disprove claims made by the accuser, and are accepted as valid proof in Iranian and Afghan laws with the distinction that in Hanafi jurisprudence, is used solely in acquittal, and not in accusation cases.}, keywords = {oath,Proof of Crime,Imami Jurisprudence,Hanafi Jurisprudence,Law of Iran,Law of Afghanistan}, title_fa = {امکان‌سنجی اثبات جرم با سوگند از منظر فقه امامی و حنفی با رویکردی تطبیقی به حقوق ایران و افغانستان}, abstract_fa = {دلیل عبارت از امری است که اصحاب دعوا برای اثبات دعوا یا دفاع از دعوا به آن استناد می­‌نمایند. در یک نگاه کلی، ادله اثبات دعاوی کیفری با در نظر گرفتن درجه اعتبار و رتبه، به ترتیب عبارتند از: علم قاضی، اقرار، شهادت، سوگند و قسامه. بر این اساس، «سوگند»، در مواردی دلیل محسوب می‌شود که دلیل قوی‌تری برای اثبات مدعا در دسترس نباشد. به لحاظ قلمرو اثباتی، از نظر فقهای امامیه در حدود و تعزیرات با توجه به روایات نبوی «البینة علی المدعی و الیمین علی من انکر» و «لایمین فی حد»، مطلقاً قسم نیست، اما در قصاص و دیه راه دارد. با توجه به اینکه فقه امامیه، مبنای قوانین موضوعه ایران قلمداد می­‌گردد، مطابق ماده ۲۰۸ قانون مجازات اسلامی ایران نیز حدود و تعزیرات با سوگند، نفی یا اثبات نمی‌شود، لیکن قصاص، دیه، ارش، ضرر و زیان ناشی از جرایم، با سوگند اثبات می‌شود. در رأی فقهای حنفیه، قاعده درء از یک سو و روایت «لایمین فی حد» از سوی دیگر، مانع پذیرش سوگند در حدود می­‌شود، اما ادای قَسم در فرض نبود بینه برای مدعی، در مورد قصاص نفس و سرقت (به لحاظ ضمان مالی) و نظایر آن، به دلیل دارا بودن جنبه حق‌الناسی، مجاز است. در قصاص عضو نیز با توجه به اینکه فقیهان حنفی، اعضای بدن را به دلیل عهده­‌داری محافظت بدن از آسیبها، همسان مال می­‌دانند، مانند امور مالی، مجرای قَسم­ اعلام می­‌کنند. آنچه از آراء فقهای حنفی گفته شد، در خصوص حقوق موضوعه افغانستان نیز ساری و جاری است؛ زیرا مطابق ماده 2 قانون مجازات کشور مذکور، در غیر از تعزیرات، مطابق فقه حنفیه عمل می­‌شود. تعزیرات نیز چون از نگاه فقهای حنفی، حق­‌الناس محض به حساب می­‌آید، قابلیت رد با ادای سوگند را دارد. افزون بر این همه، قسامه به عنوان مجموعه سوگندهایی که از طرف مدعی و بستگان او در موارد لوث برای اثبات ادعای قتل و جرح و یا از طرف مدعی علیه در صورت نکول مدعی، برای انکار آن ادا می­‌شود، در فقه امامیه و حنفیه و حقوق موضوعه ایران و افغانستان به عنوان دلیل خاص امور جنایی، پذیرفته شده است، با این تفاوت که فقهای حنفی، اثر آن را به رفع اتهام (و نه اثبات جنایت) منحصر ساخته­‌اند.}, keywords_fa = {سوگند,ادله اثبات جرم,فقه امامی,فقه حنفی,حقوق ایران,حقوق افغانستان}, url = {https://foroughevahdat.mazaheb.ac.ir/article_130319.html}, eprint = {https://foroughevahdat.mazaheb.ac.ir/article_130319_34bad3ac04b087817e716d08a31db554.pdf} }
