Many of them permit women to be an administrator or successor. They have their own reasoning not letting women be an administrator or successor the same way they cannot be a judge. Some Imami hadiths forbid women to be an administrator or successor as these hadiths have the presumption that women do not have the required conditions for being an administrator or successor; some other Imami jurists interpreted these hadiths as Taqiyah.  But most of Sunni religious groups permit women to be an administrator or successor and such permission rejects the idea of Taqiyah in this regard. Some other Sunni groups like ‘Ata’ and Shafi‘i do not accept women as an administrator or successor considering similar reasons like forbiddance of women to be judges. Their quotes are tangible as there are incidents in Islamic history showing that women can also be successor. For example, Hafsah who was appointed by Omar as an administrator, acceptance of woman’s testimony, acceptance of Hind as the administrator of her children in their living costs and etc. Some Sunni jurisprudential denominations do not accept women as an administrator of their children in marriage and some other groups restricted that to raising children.}, keywords = {Administrator or Successor,Woman,Jurisprudential Denominations,Judgement}, title_fa = {بررسی امکان وصی شدن زن از دیدگاه مذاهب فقهی اسلامی}, abstract_fa = {مذاهب فقهی اسلامی درباره شرط مذکر بودن وصی به عنوان یکی از ارکان وصیت عهدی اختلاف نظر دارند. اکثر ایشان وصی شدن زن را جایز دانسته‌اند. بررسی دلایل موافقان و مخالفان وصی شدن زن، از جمله عدم جواز وصی شدن زن به دلیل عدم جواز قاضی شدن وی، حائز اهمیت هستند، برخی از روایات امامیه از وصی شدن زن نهی نموده‌اند، این نوع روایات از فرضی سخن می‌گویند که زن واجد شرایط لازم وصی شدن، مانند بلوغ، عقل و غیره نباشد. برخی از فقهای امامیه، این نوع روایات را بر تقیه حمل نموده‌اند، اما به دلیل آنکه بیشتر قریب به اتفاق مذاهب فقهی اهل‌سنت، وصی شدن زن را جایز دانسته‌اند، حمل این روایات بر تقیه مورد تردید است. گرچه برخی از اهل‌سنت، مانند عطا و شافعیه در یکی از اقوالشان وصی شدن زن را با استناد به دلایلی، مانند عدم جواز قاضی شدن زن و غیره رد نموده‌اند، اما قول ایشان «شاذ» بوده و ادله‌ای، مانند وصی شدن حفصه توسط عمر، پذیرش شهادت زن، قیم شدن هند در نفقه فرزندانش و غیره، صحت وصی شدن زن را تأیید می‌کنند. برخی از مذاهب فقهی اهل‌سنت وصی شدن زن برای ازدواج فرزندان را صحیح ندانسته و برخی از ایشان آن را به تربیت فرزندان محدود نموده‌اند.}, keywords_fa = {وصی,زن,مذاهب فقهی,قضاوت}, url = {https://foroughevahdat.mazaheb.ac.ir/article_68635.html}, eprint = {https://foroughevahdat.mazaheb.ac.ir/article_68635_14bd12f2241d3a987493a0c667756089.pdf} }
