The need to examine the mentioned question is doubly important because, in this regard, there are differences of opinion among the jurists of Islamic schools of thought. The necessary information to answer the mentioned question has been collected through the library method and analyzed through the descriptive-analytical method. Among the reviewed items is the way of paying the price; The Imamiyyah do not differentiate between paying the price to the customer immediately or deferred, but Hanafi and some Shafi‘i jurists believe that “Shafi‘” is free to choose between paying the price immediately or deferred, Maliki, Hanbali, and some other Shafi‘i jurists consider “Shafi‘” as subordinate to the buyer. Another example is the dispute regarding the profits earned from the sold item; The Imamiyyah considered the connected earned profits to belong to the “Shafi‘” and the detached earned profits to the customer, but the Sunni jurists considered the increase that does not last to belong to the customer, and they disagree about what lasts. In addition to the above two cases, other cases of customer rights have been examined in the present article from the perspective of jurists of Islamic denominations.}, keywords = {Customer Rights,Shuf‘a Right,Selling,Shafi‘,Islamic Denominations}, title_fa = {واکاوی حقوق مشتری در شفعه از منظر فقهای مذاهب اسلامی}, abstract_fa = {در «شفعه»، در مقابل ضرری که ممکن است متوجه شریک شود، مشتری نیز در معرض تضرر قرار دارد، از این رو باید بررسی شود که «در باب شفعه، مشتری چه حقوقی داشته و در چه مواردی حق وی مقدم بر شریک است؟». ضرورت بررسی پرسش مذکور از این جهت دارای اهمیت مضاعف است که در این خصوص، بین فقیهان مذاهب اسلامی اختلاف‌نظرهایی وجود دارد. اطلاعات لازم برای پاسخ به پرسش مذکور به روش کتابخانه‌ای گردآوری و با روش توصیفی - تحلیلی، بررسی شده است. از جمله موارد بررسی شده، نحوه‌ پرداخت ثمن است؛ امامیه بین پرداخت ثمن به مشتری به صورت حال یا مؤجل، قائل به تفکیک نشده‌اند، اما حنفیه و برخی از فقهای شافعی، شفیع را مخیر بین پرداخت ثمن به صورت حال یا مؤجل کرده‌اند، فقهای مالکی، حنبلی و برخی دیگر از شافعیه، شفیع را تابع خریدار می‌دانند. نمونه دیگر، اختلاف در خصوص نماء حاصل از مبیع است؛ امامیه، زیادت متصل را متعلق به شفیع و زیادت منفصل را متعلق به مشتری دانسته‌اند، اما فقهای اهل سنت، افزایشی که دوام نداشته باشد را در مال مشتری دانسته و در مورد آنچه دوام دارد، اختلاف‌نظر دارند. علاوه بر دو مورد فوق، موارد دیگری از حقوق مشتری در مقاله پیشاروی از منظر فقهای مذاهب اسلامی مورد بررسی قرار گرفته است.}, keywords_fa = {حقوق مشتری,شفعه,بیع,شفیع,مذاهب اسلامی}, url = {https://foroughevahdat.mazaheb.ac.ir/article_164434.html}, eprint = {https://foroughevahdat.mazaheb.ac.ir/article_164434_27ce0b2387432ccf7ace8140af36536e.pdf} }
