Abstract
The topic of “preserving the Nezam” (sovereignty) is an issue that always Islamic scholars pay attention and emphasize to it in jurisprudence and Islamic texts. With paying attention to spread function of the necessity of “preserving the Nezam” in different sections of jurisprudence and also in most of these cases “preserving the Nezam” is relying as a reason for Shar’ee orders (Hokm), so we could examine this subject as a jurisprudence important and spread method. Although the past Jurisprudence texts didn’t mention to this method but this general and common method is one of jurisprudence orders (Hokm) of Islamic sects. The main subject of this article is to illustrate that this is an order (Hokm) in Shar’ee orders’ field. The research’s method of this article is descriptive and library work. The method works in this way that at first different meaning of the word Nezam would discuss with paying attention to concept of this word. Then this jurisprudence method would examine Shar’ee orders in spread of issuance of secondary and Velaee orders and also the way of relaying primary orders.
