Emamiyeh’s jurisconsult incumbent respecting dignity of poor and indigent person, but they enjoin to him that s/he must attempt to pay his/her dept with all legal (Shari’ee) ways, but the wealthy debtor who does not pay his/her debt is sans from this respect and s/he is deserving the Ruler’s crackdown. In Emamiye’s jurisprudence come in contact with a debtor who does not pay his debt could divide in two branches: in first view such a debtor must arrested from the ruler, but in the second view the ruler for arresting the debtor is free to chose. Furthermore, in Shafe’ee’s jurisprudence with arresting and Ta’zir the property of debtor also would sell. It seems that there is no need to arrest the fiscal owing because when the point is totally fiscal and debtor is wealthy we could besides upon arrival the claim use new ways for fiscal punishments.
